DECKARD — Terms of Use

These terms are an agreement between you and Jaume Muntal, Masia Can Carerac s/n, 08140 Caldes de Montbui (Barcelona), Spain ("we", "us"), the developer of DECKARD. By creating an account or using the app you agree to them. If you do not agree, do not use DECKARD.

These terms sit alongside Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which governs your licence to the app itself. Where the two differ on something the Apple agreement covers, the Apple agreement applies.

1. Who can use DECKARD

You must be at least 18 years old. You need an account, and you are responsible for what happens under it. Tell us at support@usedeckard.com if you think someone else is using it.

2. What DECKARD is, and what it is not

DECKARD analyses photographs of a face, and on a phone with a depth sensor a 3D scan of it, and returns scores, a place on a scale used by an online community, a routine and related content.

3. Photographs of other people

Rate Anyone lets you rate a photograph of someone else. You may only upload a photograph of an adult who has agreed to it, and only one you have the right to use. Do not upload anyone under 18; DECKARD refuses to rate a face that appears to be a minor. Do not use DECKARD to harass, shame or embarrass anyone, including by sharing their rating. A photograph uploaded through Rate Anyone is deleted once it has been rated.

4. Your content

You keep every right you have in the photographs and scans you upload. You give us a licence to store and process them only to provide DECKARD to you: to rate them, keep them in your account, show them back to you and delete them when you ask. We do not use them to advertise, we do not sell them, and we do not publish them. How we handle them is set out in the Privacy Policy (https://usedeckard.com/privacy/).

6. Acceptable use

Do not: upload anything that is not a photograph of a real adult face you may use; upload anything illegal, sexual or violent; try to get around the limits of your plan, the age check or the payment system; reverse engineer the app or its servers except where the law allows it; or use DECKARD to build a competing product or dataset. We may suspend or close an account that does, and will tell you why unless the law prevents it.

7. Changes and availability

We improve DECKARD continuously, and the way ratings are produced may change, so a later rating may not be comparable with an earlier one. We may change these terms; if a change matters to you we will tell you in the app before it takes effect, and continuing to use DECKARD after that means you accept it. We may stop offering DECKARD; if we do, we will give reasonable notice and a way to download your data.

8. Ending your account

You can delete your account at any time in the app (Account → Delete account). That deletes your photographs, scans and everything attached to them, as described in the Privacy Policy. Deleting the app does not cancel a subscription — cancel it with Apple.

9. Liability

Nothing in these terms limits a liability that the law does not allow to be limited, including for death or personal injury caused by negligence, for fraud, or under consumer protection law that applies to you. Otherwise, we are not liable for losses that were not foreseeable, and our total liability to you is limited to what you paid us in the twelve months before the claim.

10. Law and disputes

These terms are governed by the law of Spain. If you are a consumer, you also keep the protection of the mandatory law of the country you live in, and you can bring a claim in its courts. The European Commission's online dispute resolution platform is at https://ec.europa.eu/consumers/odr.
